Terms of Service

§ 1. General Provisions
1.1. These Terms of Service govern the provision of services by Anna Parda, operating a sole proprietorship in 12-200 Pisz, Poland (hereinafter referred to as the "Service Provider").
1.2. These Terms define the rights and obligations of the Service Provider and the Client.

1.4. Definitions used in these Terms:
Client – a natural person, legal entity, or organizational unit without legal personality that uses the Services offered by the Service Provider.
Consumer – a natural person entering into a transaction with the Service Provider for purposes outside their business or professional activity.
Entrepreneur on Consumer Rights – a natural person entering into an agreement directly related to their business activity when the content of that agreement shows that it does not have a professional character for them.
Services – coaching services, Human Design readings, Sacral Clarity sessions, and digital products offered by the Service Provider.
Website – the Service Provider's website where the Services are presented.
Session – an individual online meeting with the Client as part of the Services provided.
Digital Products – materials in electronic form (PDF reports, recordings) delivered to the Client electronically.
§ 2. Scope of Services
2.1. The Service Provider offers the following categories of services:
a) Individual coaching sessions (in various formats and packages)
b) Human Design readings and Sacral Clarity sessions
c) Digital products (Human Design reports in PDF format)
2.2. Detailed information about the current offer, prices, session duration, and terms of individual services is available on the Website and in the booking system.
2.3. All sessions are conducted online via Google Meet.
2.4. The Service Provider may record sessions and provide them to the Client in video and audio format if included in the service offering. The Client will be informed about recording before the session begins.
2.5. As part of some services, the Client receives additional materials (reports, session recordings) – the scope of materials is specified in the service description.
§ 3. Booking and Payment
3.1. Session booking is done through the online booking system available on the Website.
3.2. Payment for Services is made through the online payment system (Stripe).
3.3. Prices stated on the Website at the time of booking are final and binding for both parties.
3.4. The Service Provider is not a VAT payer. The stated prices are net prices.
3.5. Payment for sessions is required in advance before the session date.
3.6. For multi-session packages, the Client may have the option to pay in installments according to the terms specified for that service.
3.7. After payment is made, the Service Provider issues an invoice, which is sent to the email address provided by the Client.
3.8. Digital products are delivered automatically to the email address provided during purchase, after payment has been processed.
§ 4. Cancellation and Rescheduling
4.1. The Client may cancel or reschedule a session by informing the Service Provider at least 24 hours before the scheduled time.
4.2. Cancellation or rescheduling of a session should be reported by email to: hello@annaparda.com.
4.3. Each session may be rescheduled once without additional charges. In case of illness, unforeseen circumstances, or other justified reasons, the Service Provider may agree to additional rescheduling.
4.4. Cancellation with less than 24 hours' notice or failure to attend the session without prior notification (no-show) results in forfeiture of the session fee. The session is considered completed.
4.5. If the Service Provider must cancel a session due to circumstances beyond their control, the Client will receive the option to reschedule the session or receive a full refund for that session.
§ 5. Right of Withdrawal
5.1. In accordance with the Consumer Rights Act of May 30, 2014, Consumers and Entrepreneurs on Consumer Rights have the right to withdraw from a distance contract within 14 days from the date of concluding the contract, without giving a reason.
5.2. The right of withdrawal does not apply in the following cases:
a) Services whose performance has begun with the express consent of the Consumer before the expiry of the 14-day period and after informing them by the Service Provider about the loss of the right of withdrawal.
b) Supply of digital content not supplied on a tangible medium, if performance has begun with the express consent of the Consumer before the expiry of the withdrawal period and after informing them by the Service Provider about the loss of the right of withdrawal.
5.3. By booking a session scheduled less than 14 days from the booking date or ordering a digital product, the Client consents to immediate performance of the service and confirms they have been informed about the loss of the right of withdrawal.
5.4. A withdrawal statement may be submitted as an unequivocal statement by email to: hello@annaparda.com or by post.
5.5. In case of effective withdrawal from the contract, the Service Provider will refund all payments received from the Client without undue delay, no later than 14 days from receipt of the withdrawal statement.
§ 6. Refunds and Complaints
6.1. Digital products:
a) After downloading or receiving access to a digital product, no refund is available, in accordance with Article 38(13) of the Consumer Rights Act.
b) The Client consents to immediate delivery of the digital product and thereby loses the right of withdrawal.
6.2. Individual sessions:
a) A refund for a session is available only if the Service Provider cancels the session and it is not possible to set a new date acceptable to the Client.
b) No refund is available in case of:
Cancellation by the Client with less than 24 hours' notice
Failure of the Client to attend the session (no-show)
Client's withdrawal from the session after it has taken place
6.3. Multi-session packages:
a) In case of mutual agreement to end cooperation before completing all sessions in the package, the Client is entitled to a refund for unused sessions.
b) The refund is reduced by the value of sessions already completed and sessions that the Client canceled with less than 24 hours' notice or failed to attend.
c) Payment refund occurs within 14 days from the date of mutual agreement to end cooperation.
6.4. Complaints:
a) The Client has the right to submit a complaint regarding the quality of Services within 14 days from the date of session completion or receipt of a digital product.
b) Complaints should be submitted by email to: hello@annaparda.com or by post.
c) The complaint should contain:
Client's first and last name
Email address or correspondence address
Subject of the complaint (service name, date of completion)
Justification of the complaint
Expectations toward the Service Provider
d) Complaints are processed within 14 days from receipt. The Client will be informed about the complaint outcome via the email address or correspondence address provided in the complaint.
§ 7. Copyright and Intellectual Property
7.1. All materials provided by the Service Provider as part of the Services, including session recordings, reports, presentations, and other content, are protected by copyright and constitute the intellectual property of the Service Provider.
7.2. The Client receives a non-exclusive, non-transferable license to use the received materials exclusively for their own personal use.
7.3. Without written consent from the Service Provider, the following is prohibited:
a) Sharing, transferring, or distributing materials to third parties
b) Copying, duplicating, or reproducing materials in whole or in part
c) Publishing materials on the Internet or other media
d) Using materials for commercial purposes
e) Resale or paid sharing of materials
7.4. Violation of this section may result in civil and criminal liability provided by law.
§ 8. Limitation of Liability
8.1. Coaching services, Human Design readings, and Sacral Clarity sessions offered by the Service Provider are educational and developmental in nature.
8.2. The Services do not constitute:
a) Medical advice or treatment
b) Psychological advice or psychotherapy
c) Legal advice
d) Financial or investment advice
8.3. The Client bears full responsibility for decisions made based on information, guidance, or inspiration obtained while using the Services.
8.4. The Service Provider is not liable for the consequences of decisions made by the Client, including any material or non-material damage resulting from such decisions.
8.5. In case of physical or mental health problems, the Client should immediately consult with a qualified specialist (physician, psychologist, psychiatrist, therapist).
8.6. Use of the Services does not replace professional medical, psychological, legal, or financial care.
§ 9. Data Protection
9.1. The controller of Clients' personal data is Anna Parda, 12-200 Pisz, Poland, email: hello@annaparda.com.
9.2. Clients' personal data is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and data protection laws.
9.3. Detailed information regarding the processing of personal data, including purposes, legal bases, retention period, and Client rights, is contained in the Privacy Policy available on the Website.
§ 10. Final Provisions
10.1. In matters not regulated by these Terms, the provisions of Polish law shall apply, in particular:
a) Civil Code of April 23, 1964
b) Consumer Rights Act of May 30, 2014
c) Act on the Provision of Electronic Services of July 18, 2002
10.2. Any disputes arising from the performance of the Agreement will be resolved by the competent court in accordance with the provisions of the Code of Civil Procedure, taking into account the mandatory provisions regarding court jurisdiction in consumer matters.
10.3. Consumers and Entrepreneurs on Consumer Rights have the right to use out-of-court methods of handling complaints and pursuing claims. Information on how to access these procedures is available on the website of the Office of Competition and Consumer Protection: www.uokik.gov.pl.
10.4. The Service Provider reserves the right to change these Terms for important reasons, such as:
a) Changes in legislation
b) Introduction of new services or functionalities
c) Improvement of operations or security of Services provided
d) Adaptation to requirements of supervisory authorities
10.5. Clients will be informed about planned changes to the Terms at least 7 days in advance via email or information on the Website.
10.6. Changes to the Terms do not affect Agreements concluded before the effective date of the changes, unless the Client consents to the application of the new Terms.
10.7. The current version of the Terms is always available on the Website.
